This book is the first comprehensive assessment of the legal duties of states with regard to human induced climate change damage. By discussing the current state of climate science in the context of binding international law, it convincingly argues that compensation for such damage could indeed be recoverable. The author analyses legal duties requiring states to prevent climate change damage, and discusses to what extent a breach of these duties will give rise to state responsibility (international liability). The analysis includes the UN Framework Convention on Climate Change and the Kyoto Protocol, but also various nature/ biodiversity protection and law of the sea instruments, as well as the no-harm-rule as a key provision of customary international law. The challenge in applying the different aspects of the law on state responsibility, including causation and standard of proof, are discussed in three case studies, and the questions raised by multiple polluters explored in depth. Against this background, the author advocates an internationally negotiated solution to the issue of climate change damage.

The telephone invaded their conversation at just that moment. April turned and looked at the detective. He nodded his head and gave her the go ahead. Visibly quivering she took a deep breath in and picked up the receiver. "Hello?" she questioned the caller in a whisper. Gil jumped up from his seated position and said anxiously, "April!" She heard Gil let out a heavy breath. "Thank God you answered; I was wondering what was taking so long for you to call. Let me speak to Renee!" "Gil..." O'Keefe pulled the handset out of her hand. "Mr. Thompson?" Hesitantly Gil answered. "Yes. Who is this?" "I'm Detective O'Keefe with the Santa Fe PD," Gil heard the name and froze. "Who? Why are you in my house? What's wrong? Put April back on the phone." "Mr. Thompson. Ms. Hunter is here by me. I need you to listen to me. I need to inform you-" Gil didn't hear what came next. His conscious self detached from his body and he floated. Inform. He felt weak, faint, what now. He didn't comprehend the policeman's words. "Mr. Thompson, are you there, sir?" "What? I'm sorry I didn't hear you. What happened?" "It's your wife, sir..." http: //wreckagebook.tripod.com

Based on research from more than 10,000 surveys from children and parents of divorce, Collateral Damage presents parents with an overview of the negative impact that divorce has on their children and offers ways to better serve their needs at this critical time. Approximately fifty percent of marriages in the United State fail. Add to that the increasing number of couples who never marry, have children together, and later go their separate ways. In all of these scenarios, children suffer greatly—often in silence, as parents do not know how to effectively guide their kids. When the sorrow and emotional issues of children are not addressed, the cycle of divorce is likely to continue for them and in generations that follow. In addition, while children may appear to be resilient and adjusting, without proper support children of divorce are more prone to drug and alcohol abuse, criminal behavior, mental and physical illness, and suicide. How can parents manage their own hurt, shock, anger, and despair so that they can provide their children with what they need? While Collateral Damage does not advocate divorce, it does sound a wakeup call for parents. It identifies the landmines inherent in the dangerous terrain of divorce and equips them to help their children not to feel abandoned or unheard. Topics covered include: Building the family—not losing it Tuning into your kids Stabilizing childhood Maintaining parent/child roles Avoiding the parenting handoff Keeping kids out of the war zone Instilling trust Keeping open lines of communication Attuning to guiding, spiritual resources The unfortunate failure of a marriage does not mean the end of the family. Providing a stable, supportive, healthy relationship with your child demonstrates what a loving relationship looks like, better preparing them for intimate relationships and marriage as an adult.
